Terms of Service

These terms apply to everything Native Fluency offers: this website (nativefluency.co), the Fluency Moments app on iPhone and inside Meta's Muse app, Song Studio, and any other Native Fluency service that links to this page. Native Fluency is a brand of Cammellatte LLC, a Delaware limited liability company ("we", "us"). By using any of these services, you agree to these terms. If you do not agree, please do not use them.

How this page works: Part A applies to every Native Fluency service. Part B adds the rules that apply to one product only. If Part B says something different from Part A for a product, Part B wins for that product.

Part A. Terms for all Native Fluency services

1. Who can use our services

• You must be at least 13 years old.
• If you are under 18, you need permission from a parent or guardian.
• Some products set a higher age. Song Studio, for example, is for adults only (see Part B).

2. Your account and access

• Keep your password, access codes and pairing codes private. Do not share, sell or post them.
• Where a service has accounts, your account is personal to you. You cannot give, sell or transfer it to someone else.
• You are responsible for what happens in your account. If you think someone else has used it, tell us at [email protected].

3. What you must not do

Do not:

• use our services for anything illegal, harmful, harassing or hateful;
• try to get into another person's account or data;
• try to break, overload, or get around our limits and security;
• copy, scrape, or download our material in bulk, or resell anything from our services;
• use our services to build a competing product or to train AI models;
• upload or send content you have no right to use.

4. About AI-generated content

Parts of our services, such as Fluency Moments conversations and Song Studio study material, are written by AI models. AI models make mistakes. A reply can misunderstand you, and an explanation can be wrong. Please treat everything the AI writes as a practice aid, not as a final authority on the language. It is not professional, medical, legal or financial advice. Do not rely on it for decisions that matter.

5. Your content

You keep whatever rights you have in what you write, record or upload. You give us permission to process your content only as needed to run the features you use, for example to send your reply to an AI model and show you its answer. Our Privacy Policy explains what we store and for how long.

6. Our content

Our apps, website, lessons, prompts, designs and brand belong to us or to the people who license them to us. You may use them for your own language learning. You may not copy, sell or republish them without our written permission.

7. Payments

• Purchases made through an app store (for example, a Fluency Moments Plus subscription on iPhone) are billed by that store. The store's own terms decide billing, cancellation and refunds.
• If you buy coaching or another service directly from us, the offer or agreement you receive for it applies in addition to these terms.
• If we ever charge for something that is free today, we will tell you first. You only pay if you agree.

8. Other companies' services

Some of our services run inside, or connect to, services from other companies, such as Apple's App Store, Meta's Muse app, and Skool. Those companies' own terms and privacy policies apply to their part. We are not responsible for how their services work.

9. Privacy

How we handle personal data is explained in our Privacy Policy at nativefluency.co/privacy.

10. Suspending or ending access

You can stop using our services at any time. To have your account and data deleted, email [email protected] from the address you use with us. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering a service. Where we can, we will tell you why first, and give you advance notice before we shut a service down.

11. No guarantees, and limits on our liability

We provide our services as they are. As far as the law allows, we make no promise that they will always be available, free of errors, or right for your purposes. Features may change, and some may be removed.

As far as the law allows, we are not liable for indirect losses, lost data, or lost profits. Our total liability to you for anything related to our services is limited to USD 50 or the amount you paid us in the 12 months before the claim, whichever is higher.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or for intent or gross negligence. If you live in the EU or another country with consumer protection laws, you keep all rights those laws give you.

12. Governing law

These terms are governed by the laws of the State of Delaware, United States. If you are a consumer living in the EU or another country whose law gives you protection that cannot be set aside by agreement, you keep that protection, and you may bring a claim in the courts where you live.

13. Changes to these terms

We may update these terms. For important changes, we will tell you in the app, on this page, or by email at least 14 days before they apply. If you keep using our services after that, the new terms apply. If you do not agree, you can stop using them.

Part B. Extra terms for each product

Fluency Moments

Fluency Moments gives you short conversations in the language you are learning. An AI conversation partner asks you a question, responds to what you mean, and keeps the exchange going. By design it does not correct, grade or praise your language.

• No account. Fluency Moments does not ask for your name, email address or an account. We do not know who you are when you use it.
• Optional link to Song Studio. If you have a Song Studio account, you can enter your Song Studio pairing code in the app. That links your app to your Song Studio account, so conversations can use the words and expressions you are studying there. Remove the code in the app's settings to unlink. Keep your pairing code private (see Part A, section 2).
• What we keep. We do not store what you write in a Fluency Moments conversation. Your message passes through our server to an AI model, the reply comes back to you, and our server keeps no copy of the conversation. Details are in our Privacy Policy.
• On iPhone. Finished conversations are saved on your own device, not on our servers. Apple's Standard License Agreement also applies to the iPhone app. Fluency Moments Plus is an auto-renewing subscription billed by Apple. You can cancel it in your Apple account settings, and refunds are handled by Apple.
• In Muse. When you use Fluency Moments inside Meta's Muse app, Muse sends your messages to our service and shows you our replies. Meta's own terms and privacy policy apply to Muse, including what Meta does with your conversation. We do not take payments inside Muse. You can disconnect Fluency Moments in Muse at any time, and our service then receives nothing further from you. Fluency Moments in Muse is new, and we may change, limit or withdraw it.
• Fair use. To keep the service running and costs under control, we limit how many conversations can be started in a given time. If you reach a limit, you can continue later.

Song Studio

Song Studio, at studio.nativefluency.co, has its own full terms of use at studio.nativefluency.co/terms. They cover the music you upload, copyright complaints, the beta, and the adults-only age rule. For Song Studio, those terms apply in addition to Part A, and where they differ, the Song Studio terms win.
